AB 341 – Mandatory Commercial Recycling
California's AB 341 (Assembly Bill 341) took effect on July 1, 2012, establishing mandatory commercial recycling requirements for qualifying businesses and multifamily residential properties.
Businesses (including public entities) and multifamily residential dwellings with five or more units are required to arrange for recycling services. Depending on your location and the amount of waste generated, additional recycling requirements may also apply.
If your business is not currently recycling, MarBorg can help you establish a program that diverts recyclable material from the landfill while potentially reducing your monthly disposal costs.
Purpose of the Law
AB 341 was created to reduce greenhouse gas emissions by diverting commercial solid waste from landfills while expanding recycling opportunities and supporting California's recycling infrastructure.
Commercial Recycling Requirements
Businesses that generate four cubic yards or more of commercial solid waste per week, along with multifamily residential properties containing five or more units, must arrange for recycling services.
Businesses may comply by using one or a combination of the following methods:
Self-haul recyclable materials.
Subscribe to recycling collection through a licensed hauler.
Arrange for pickup of recyclable materials.
Subscribe to a recycling service that includes mixed-waste processing with diversion results comparable to source separation.
Commercial property owners and multifamily housing owners may also require tenants to separate recyclable materials to assist with compliance.
AB 1826 – Mandatory Commercial Organics Recycling
California adopted AB 1826 (Assembly Bill 1826) in 2014, creating mandatory commercial organics recycling requirements that began taking effect in 2016.
For purposes of the law, organic waste includes:
Food waste
Green waste
Landscape and pruning waste
Nonhazardous wood waste
Food-soiled paper mixed with food waste
As of January 1, 2019, businesses (including public entities) and multifamily residential properties with five or more units that generate four cubic yards or more of solid waste per week are required to recycle their organic waste.
For assistance understanding these requirements or establishing organics recycling service, please contact MarBorg at (805) 963-1852.
Purpose of the Law
AB 1826 was phased in over time, beginning with California's largest organic waste generators, with the long-term goal of keeping compostable materials out of landfills.
When organic waste decomposes in a landfill, it releases methane—a greenhouse gas significantly more potent than carbon dioxide. Diverting food scraps, green waste, and other organic materials helps reduce these emissions.
Implementation Timeline
April 1, 2016: Businesses generating eight cubic yards or more of organic waste per week were required to recycle organic waste.
January 1, 2017: Businesses generating four cubic yards or more of organic waste per week were required to recycle organic waste.
January 1, 2019: Businesses generating four cubic yards or more of solid waste per week were required to recycle organic waste.
